Terms of Service

1. Acceptance of Terms

By accessing or using Cycbase ("the Service"), you agree to be bound by these Terms of Service and all applicable South African laws. If you do not agree, you may not use the Service. These terms are governed by the laws of the Republic of South Africa. The Electronic Communications and Transactions Act 25 of 2002 ("ECT Act") and the Consumer Protection Act 68 of 2008 ("CPA") may apply where relevant. Note: Cycbase is a free personal-use platform and does not offer goods or services for sale; the supplier disclosure provisions of ECT Act section 43 are therefore not applicable.

2. Description of Service

Cycbase is a personal cycling management platform that allows users to log rides, manage bicycles, track service history, and record race results. The Service is provided on an as-is basis for personal, non-commercial use.

3. Account Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 13 years of age to use the Service. You agree to notify us immediately of any unauthorised use of your account.

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any South African law
  • Attempt to gain unauthorised access to any part of the Service
  • Upload malicious code, viruses, or any harmful content
  • Impersonate any person or entity
  • Collect or harvest other users' data without consent

5. Intellectual Property

All content, trademarks, and intellectual property within the Service remain the property of Cycbase. Your personal ride data remains yours. You grant Cycbase a limited licence to store and process your data solely for the purpose of providing the Service to you.

6. Disclaimer of Warranties

To the extent permitted by the CPA, the Service is provided without warranties of any kind. Cycbase does not warrant that the Service will be uninterrupted, error-free, or fit for any particular purpose. Cycling is an inherently risky activity — Cycbase accepts no liability for any injury, accident, or loss arising from use of or reliance on the Service.

7. Limitation of Liability

Subject to the mandatory consumer protection provisions of the CPA, Cycbase's liability for any claim arising out of or in connection with the Service shall not exceed the amount you paid (if any) in the 12 months preceding the claim. Cycbase is not liable for any indirect, incidental, or consequential damages.

8. Termination

You may delete your account at any time. Cycbase may suspend or terminate your account if you breach these terms. Upon termination, your personal data will be handled in accordance with our Privacy Policy and POPIA.

9. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms. We will notify registered users of material changes via email.

11. Governing Law & Jurisdiction

These terms are governed by the laws of the Republic of South Africa. Any dispute shall be subject to the jurisdiction of the South African courts. For consumer disputes, you may also approach the National Consumer Commission or a relevant Ombud in terms of the CPA.
